United States (EMTALA case)"},"content":{"rendered":"<p>SCOTUS Sheepishly Admits It Shouldn\u2019t Have Taken Emergency Abortion Case<\/p>\n<p style=\"padding-left: 40px;\">The embarrassing reversal \u2014\u00a0which was <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-06-26\/us-supreme-court-poised-to-allow-emergency-abortions-in-idaho?srnd=undefined&amp;embedded-checkout=true\" target=\"_blank\" rel=\"nofollow noopener\">accidentally disclosed a day early<\/a> when it was \u201cinadvertently and briefly uploaded\u201d to the Supreme Court\u2019s website \u2014 plainly indicated a growing rift at the court: the three liberal justices, who see this case as a very simple one; three conservative justices \u2014\u00a0Barrett, Kavanaugh and Roberts \u2014\u00a0who appear suddenly conflicted about their role putting women\u2019s health in jeopardy; and the ultra-conservative faction \u2014\u00a0Justices <a id=\"auto-tag_samuel-alito\" href=\"https:\/\/www.rollingstone.com\/t\/samuel-alito\/\" data-tag=\"samuel-alito\">Samuel Alito<\/a>, <a id=\"auto-tag_clarence-thomas\" href=\"https:\/\/www.rollingstone.com\/t\/clarence-thomas\/\" data-tag=\"clarence-thomas\">Clarence Thomas<\/a> and <a id=\"auto-tag_neil-gorsuch\" href=\"https:\/\/www.rollingstone.com\/t\/neil-gorsuch\/\" data-tag=\"neil-gorsuch\">Neil Gorsuch<\/a> \u2014\u00a0who simply don\u2019t care.<\/p>\n<p style=\"padding-left: 40px;\">Read more at <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/scotus-emtala-idaho-abortion-1235047219\/\">Rolling Stone<\/a><\/p>\n<p>Supreme Court dismisses Idaho abortion challenge, allowing doctors to perform emergency abortions<\/p>\n<p style=\"padding-left: 40px;\">Notably, EMTALA first came to light <a href=\"https:\/\/www.propublica.org\/article\/despite-federal-law-some-rural-hospitals-still-turn-away-women-in-labor#:~:text=Prompted%20by%20a%20catastrophic%20case,eliminating%20obstetrics%20departments%20because%20of\" target=\"_blank\" rel=\"noopener\">as a response to hospitals turning away uninsured pregnant people<\/a> in active labor. Congress passed the law in 1986 and specifically included provisions mandating federally funded hospitals to accept a patient in active labor even if she doesn\u2019t have insurance. President Ronald Reagan signed it into law. The purpose of EMTALA was to establish a nationwide baseline of emergency care that everyone is entitled to, regardless of where they live or their medical condition.
