Abortion rights advocates have emphasized that repealing the ban is not enough. “This is an important step, but our work isn’t done,” said Ruben Gallego, a US representative of Arizona who is running for Senate. “Arizona women deserve better. That’s why we’re going to pass a constitutional right to abortion and defeat anti-abortion extremists.”

In addition, under the Arizona state Constitution, repeals of laws don’t go into effect until 90 days after a legislative session concludes. Arizona doesn’t have a fixed legislative calendar, meaning Republicans could keep the session open with the intent to further delay the implementation of a repeal.

In the meantime, Attorney General Kris Mayes is asking the state Supreme Court to pause its ruling implementing the 1864 law so her office can craft an appeal to the U.S. Supreme Court on the grounds that the state justices improperly are injecting themselves into a different federal case about an Arizona abortion law.
